Understanding the Carbon Border Adjustment Mechanism (CBAM or MACF in French): Essential information and services for compliance

As global pressure to reduce carbon emissions increases, the European Union has introduced the Carbon Border Adjustment Mechanism (CBAM) to ensure that imported goods meet the same carbon price standards as goods produced within the EU. This mechanism is designed to prevent carbon leakage (carbon leakage occurs when companies move production to countries with less stringent emissions regulations, which does not reduce global emissions, only moves their location) and promote cleaner production processes worldwide. Key deadlines for CBAM compliance

Understanding and meeting critical deadlines is critical to maintaining compliance within the CBAM framework. Below are the key dates companies should keep in mind:

  • Jan. 1, 2023 - Dec. 31, 2025: Transition Period. During this phase, importers of certain goods must report the embedded emissions in their products without any financial adjustment. During this period, companies can adjust to the new reporting requirements and prepare for full implementation.
  • Jan. 1, 2026: Full implementation of CBAM. Importers will need to purchase CBAM certificates, which reflect the carbon price that would have been paid if the goods had been produced under EU carbon pricing rules.

These deadlines are crucial, and early preparation can reduce the risks of noncompliance, such as potential fines or trade disruptions.

Having an independent verifier becomes mandatory from Jan. 1, 2026, when full implementation of the CBAM begins. This marks the shift from merely reporting integrated emissions during the transition period (Jan. 1, 2023 - Dec. 31, 2025) to requiring importers to verify their data and purchase CBAM certificates that reflect carbon costs equivalent to EU standards. This ensures that all reported emissions data are accurate and meet the established standards.

Limits and exemptions for CBAM

CBAM includes specific limits and exemptions designed to balance environmental objectives with economic realities:

  • The Minimis Threshold: Shipments with a value of less than EUR 150 are exempt from CBAM requirements. This exemption is designed to ease the administrative burden for smaller companies and for transactions involving low-value shipments.
  • Free fees: During the CBAM transition period, certain sectors can receive free allowances. These allowances are similar to those under the EU Emissions Trading Scheme (ETS) and are intended to ease the transition for industries that need to adjust to the new regulations.
  • Exemption for developing countries: Imports from least developed countries may be exempted from CBAM. This exemption is intended to support economic development in these regions without imposing strict environmental regulations that could hinder their progress. Goods produced in the EU's outermost regions, such as La Réunion and Mayotte, are not subject to CBAM because these regions are part of the EU's customs territory. The CBAM regulation exempts goods from specific countries and territories. These exemptions apply to countries and territories that have equivalent carbon pricing measures, such as those participating in the EU Emissions Trading System (ETS) or those that have linked their domestic ETS to the EU system. The countries and territories currently exempted from CBAM are Iceland, Liechtenstein, Norway, Switzerland and the special areas of Büsingen, Helgoland, Livigno, Ceuta and Melilla.
