Changes to standards SNA as of July 1, 2022
As of July 1, 2022 a number of norm changes for the SNA hallmark have been implemented for both NEN4400-1 and NEN4400-2. It concerns three adjustment reports and the withdrawal of an interpretation report. Below we discuss the changes and what they mean for you.
Adjustment reports
The adjustment reports below are effective July 1, 2022:
- Adjustment reports 2021-273 and 2021-274-2 concern a textual clarification of standard requirement 4.2.5.2 (Subcontracting work to, and hiring and hiring on, companies not inspected on the basis of NEN 4400-1 or NEN 4400-2).
The amendment applies to companies that outsource work to subcontractors. With this modification, only the labor component is considered in the context of maximum outsourcing of work, to companies not inspected on the basis of NEN 4400-1 or NEN 4400-2. This is 5% per company or 25% of the absolute total. Also, the percentage of g-account deposit can be limited to the labor component. The material component is thus excluded. It is important, however, that the subcontractor provides substantiation that allows the labor and material components to be split. The inspector will have to be able to determine this during an inspection. If the split is properly substantiated, more can be hired or subcontracted per subcontractor without this being a problem for the SNA seal of approval. - Adjustment reports 2022-275 and 2022-276-2 concern a textual adjustment around the name Inspectie SZW.
Inspectie SZW has changed its name to Nederlands Arbeidsinspecties, therefore these adjustment reports adjust the names in the SNA standard and handbook standards. This does not affect a company's operations or inspection. - Adjustment reports 2022-277 and 2022-278-2 concern an expansion of the situations in which, during an AVV-less period, companies that have declared the ABU or NBBU collective labor agreement applicable in an individual employment contract are also inspected for a number of norm elements.
Through this adjustment, temporary employment agencies that declare the ABU CLA for Temporary Employees applicable (incorporate it) in the employment contract will be subject to an additional inspection during a period without AVVV. The check relates to the provisions concerning the accrual and withdrawal and/or payment of reserves. In addition, the pay slip must also comply with the CLA for Temporary Workers.
The relevant adjustment reports are included in the new Standards Manual version 22.02.
Interpretation report withdrawn
Finally, Interpretation Report 2018-229 has been withdrawn as it is no longer applicable due to the introduction of WAB. This does not affect a company's operations or inspection.
