Errors in id documents and checks are too common

The Netherlands Labor Inspectorate (NLA) found many errors during inspections in 2023 in establishing the identity of workers using valid identity documents. In a large number of cases, the documents were expired, forged, not valid or the identity was not recorded at all. This is according to a report by the NLA.

The standard according to the SNA seal of approval

The SNA standard states that a company must maintain accurate, complete and timely personnel records based on effective management measures. The company checks the employee's identity and entitlement to work in the Netherlands. The manner in which a company carries out this check should be evident from the administration. In doing so, the company is expected to at least comply with the government's Stappenplan ID-controle, which contains 4 elements:

  • Verification of the employee's ID
  • Verification of the employee's identity
  • Verification that the employee is allowed to work for you
  • Retention of the proof of identity

Tools for entrepreneurs

Several online tools can be used to support you as an entrepreneur. For example, the government has a mobile app DutchID and the Public Register of Authentic identity and travel Documents Online (PRADO) website can be used.

Risks of violation

If you fail to comply with the rules, you may be fined. The amount of the fine depends on the severity of the violation and starts as low as €2000 per worker. In the worst case, the Labor Inspectorate can shut down your business.

Practical experience

Normec VRO inspectors always do a "paper check" of copies of identity documents. Therefore, the correct determination of identity cannot be verified. However, errors regarding the validity of identity documents are often found during inspections. Also, driving licenses, alien passports or residence documents that do not confer a right to work are still often used. For the absence of valid identity documents, depending on the number of observations in the sample, a 3-month minor or major nonconformity counts as an anomaly. Thus, proper and complete verification of identity documents is very important.

More information on identity documents and checking them can be found on the NLA and SNA website.
