Upper House approves the Law on Admission for the Posting of Workers (Wtta)

On Nov. 11, the Senate approved the Law on the Admission of the Supply of Labor (Wtta). This law introduces a compulsory admission system for all companies that make labor available, such as temporary employment agencies, payroll companies and secondment agencies. The goal: to address abuses, better protect migrant workers and ensure a level playing field.

Key moments

• Jan. 1, 2027: The law goes into effect. Companies that want to continue lending workers must register with the Dutch Authority Uitleenmarkt (NAU) before this date.
• Jan. 1, 2028: The Dutch Labor Inspectorate starts enforcement. Lenders without authorization as well as hirers using non-authorized agencies risk substantial fines.

Conditions for approval

Permission is not without obligation. Among other things, hirers must submit a Certificate of Good Conduct (VOG), pay a deposit of €100,000, demonstrate that they meet the Wtta standards framework and actually comply with existing laws and regulations. Only then will the NAU give the green light.

Role of the NAU

The NAU (Nederlandse Autoriteit Uitleenmarkt) is an implementing organization of SZW. The organization is in the process of being set up: provisionally in The Hague, with final accommodation in Lelystad. It plays a central role in the implementation of the law and:

• grants, suspends and revokes authorizations
• grants and terminates exemptions for eligible lenders
• appoints inspection bodies and supervises their quality assurance
• manages the deposit and decides on applications for recovery
• exchanges data with, among others, the Dutch Labour Inspectorate and the Tax and Customs Administration.

The NAU will open the counters in phases. First starts the application desk for the transitional regime: from November 1, 2026 to January 1, 2027, hirers can apply to be covered by the transitional regime (based on the SNA hallmark). This will be followed by the application window for final admission: between May 1 and July 1, 2027, lenders will submit their formal application for admission, including the required inspection report.

What does this mean for your organization?

The Wtta requires timely preparation. Companies that are active in the lending of labor must start now with the sharp design and documentation of their core processes: from administration, wages and remittances to compliance (policy, implementation, monitoring), contracting and supplier selection, chain control and internal control.

The SNA seal of approval covers this broader set of requirements and acts as a basic standard for the Wtta standards framework. Those who already operate SNA can secure the Wtta additions in a targeted manner from this basis; those who do not yet have SNA can build a solid foundation towards Wtta with an SNA-compliant setup.
